1. Acceptance of Terms
By accessing and using the debtratioks.com platform operated by Debtratioks S.R.L. (hereinafter, the Platform), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services. These terms are governed by the laws of the Plurinational State of Bolivia.
2. Description of Service
Debtratioks is a digital real estate crowdlending platform that connects people interested in collectively participating in real estate projects in Bolivia. The platform provides information about available projects, facilitates collective financial participation, and provides tools for tracking participations made.
3. Eligibility
To use our services, you must be at least 18 years old and have the legal capacity to enter into binding contracts under Bolivian law (Civil Code, Art. 4). You must provide truthful, complete, and up-to-date information during the registration process and keep it current throughout your relationship with the platform.
4. Registration and Account
To access certain functionalities of the platform, you will need to create an account by providing your personal information. You are responsible for maintaining the confidentiality of your access credentials and for all activities carried out under your account. You must notify us immediately of any unauthorized use of your account.
5. Participation Risks
Participation in real estate crowdlending projects carries inherent risks. Past results do not guarantee future results. The value of participations may fluctuate and there is the possibility of losing part or all of the capital contributed. Debtratioks does not guarantee specific returns or recovery of invested capital. We recommend that you carefully evaluate your financial situation before participating in any project.
6. Fees and Charges
Debtratioks may charge fees for services provided through the platform. Applicable fees will be communicated clearly and transparently before confirming any participation. We reserve the right to modify our fee structure with at least 30 days prior notice to registered users.
7. Intellectual Property
All content on the platform, including texts, graphics, logos, images, software, and design, is the property of Debtratioks S.R.L. or its licensors and is protected by Bolivian intellectual property laws (Law No. 1322 on Copyright). Reproduction, distribution, or modification of any content without express written authorization is prohibited.
8. User Obligations
By using the platform, you agree not to provide false or misleading information, not to use the platform for illicit activities or activities contrary to morality and good customs, not to attempt to access unauthorized systems or data, not to interfere with the normal operation of the platform, and to comply with all applicable regulations in force in the Plurinational State of Bolivia.
9. Limitation of Liability
Debtratioks S.R.L. shall not be liable for indirect, incidental, special, or consequential damages resulting from the use or inability to use the platform. Our total cumulative liability shall not exceed the amount of fees actually paid by the user during the 12 months prior to the event giving rise to the corresponding claim.
10. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the Plurinational State of Bolivia. Any dispute arising from these terms shall be resolved before the competent ordinary courts of Santa Cruz de la Sierra, Bolivia, with the parties waiving any other jurisdiction that may correspond to them. The parties may previously opt for a conciliation process before the Conciliation and Arbitration Center of the Chamber of Industry, Commerce and Services of Santa Cruz.
11. Amendments
We reserve the right to modify these Terms and Conditions at any time. Changes will take effect from their publication on the platform. Continued use of the platform after any modification constitutes acceptance of the new terms. We will notify you of significant changes through the platform or by registered email.
